If the terms of a dispute resolution clause are sufficiently clear and create an enforceable obligation requiring the parties to engage in a staged approach to resolve a dispute, the courts will enforce the terms the parties agreed when they executed the contract.
Dispute resolution is a term that refers to a number of processes that can be used to resolve a conflict, dispute or claim. Dispute resolution processes are alternatives to having a court (state or federal judge or jury) decide the dispute in a trial or other institutions decide the resolution of the case or contract.
Arbitration is a mechanism for resolving disputes between investors and brokers, or between brokers. It is overseen by the Financial Industry Regulatory Authority (FINRA), and the decisions are final and binding.
A lawyer is not required in arbitration. However, because the dispute resolution process is adversarial in nature, and the outcome is often final and affects your rights, you may want a lawyer’s help in preparing and presenting your case.
The arbitrator’s final decision on the case is called the “award.” This is like a judge’s or jury’s decision in a court case. Instead, if a party wins in the arbitration and the other party does not do what the award says, the winning party may go to court to “confirm” the arbitration award.
